Subject:Revision of Anti-discrimination and/or Harassment Policy

Background:

At the April 3, 2018 council meeting Vice Mayor Mingo presented a new business item directing the Town Manager to review the Town's existing Employee Discrimination and Harassment Policy from 2003 and to provide recommendations for changes including that the Policy cover elected officials. The Town Council unanimously supported the item.

The Town's 2003 Policy is intended to prohibit discrimination and harassment in the workplace pursuant to Title XII of the Civil Rights Act of 1964.

After review, The Town Manager has adopted a series of revisions to the Policy.

The revisions to the Policy are as follows:

  • The Policy may be applicable to elected officials if adopted by Resolution of the Town Council
  • The policy reinforces applicability while conducting Town business, or outside of a work-setting (such as conferences or committee events/meetings.)
  • The policy now includes electronic forms of harassment via texts, e-mails or voicemail.
  • The complaint procedure was enhanced to allow verbal complaints.
  • The Human Resources representative was incorporated into the complaint and investigation procedures. The Town did not have an HR Specialist when the policy was written.
  • A retaliation clause was incorporated.

The amended Administrative Order 05-01.2 is attached to this memorandum for reference.
