Subject:Acceptance and Certification of May 17, 2016 Election Results

Recommendation:
It is recommended that the Town Council adopt the attached resolution providing for the acceptance and certification of the results of the May 17, 2016 Town of Miami Lakes Special Mail Ballot Election pertaining to amendments to the Town's Charter.
Background:
On March 16, 2016, the Town Counciladopted Resolution No. 16-1363, calling a Special Election on May 17, 2016 to be held via Mail Ballot (the “Election”) pertaining to amendments to the Town's Charter on the following ten (10) issues: (1) representation of the Town; (2) amending the Citizen's Bill of Rights; (3) providing for a Council-Manager form of government rather than a Mayor-Council-Manager form; (4) filling a vacancy in the mayoral seat; (5) providing for the Council to appoint the Town Manager; (6) providing for the Council to appoint the Town Attorney; (7) selection of an Acting Manager; (8) providing for four Councilmembers to call a special meeting; (9) providing for the election of mayoral and council candidates by majority vote; and (10) deleting obsolete provision concerning Charter Revision Commission membership.

The Miami-Dade County Canvassing Board has canvassed the votes cast during the Election and has reported the results to the Town's Clerk. The official Election results are attached.

Section 4.8(a) of the Town Charter provides that “when Charter amendments have been approved by the electors, the Mayor and the Town Clerk shall authenticate by their signatures the Charter amendment, such authentication to reflect the approval of the Charter amendment by the electorate.”

Accordingly, the attached resolution provides for the acceptance and certification of the Election.
