Recommendation:
It is recommended that the Town Council conditionally approve the Applicant's Variances and Site Plan to allow the construction of a residential development including eight (8) new three (3) story residential buildings with 108 total units to be located at 15800 NW 77th Court. The conditions of approval are detailed in the attached Staff Report.
Background:
The proposed project is a one hundred eight (108) unit multifamily residential development sited on an approximately 2.5 acre parcel on NW 77th Court. It is located between the Bob Graham K-8 Education Center to the north and west sides and the Courtyard Miami Lakes Hotel to the South. The Palmetto Expressway (SR 826) and NW 77th Court are east of the property. A prior application for 120 unit six (6) story residential development was previously denied by the Town Council on January 17, 2017, as it was deemed incompatible with regard to height with the surrounding area. This request is materially different in that it reflects half the height and fewer units. The applicant worked closely with Staff to arrive at a design that is more compatible with the neighborhood than the one previously submitted. To achieve greater design compatibility, variances are required to adjust the setbacks and amount of open space. Mitigation of those requests are addressed in staff's recommended conditions for approval.

The applicant has agreed to all conditions except for that related to relocating A/C units to the roof and/or clustering them at ground level, and that no Certificate of Occupancy shall be issued prior to January 1st, 2020.All conditions are provided in greater detail in the staff report. No development orders for this project should be issued until such time that all cost recovery associated with the Applicant's requests are paid in full to the Town.
